Man of the Match: Etienne Katenga Openga (KCCA FC)

(Decision: FDP No-001 of 2025) CIRCUMSTANCES OF THE CASE
Disciplinary proceedings were opened against KCCA FC upon receipt of a petition from Mbarara City FC dated 8th January 2025 stating that KCCA FC fielded an ineligible player Gavin Kizito Mugweri during the SUPL match between Mbarara City FC and KCCA FC played on 7th January 2025. Mbarara City FC in their petition stated that Gavin had accumulated three bookings from the Mbale Heroes FC vs KCCA FC, KCCA FC vs NEC FC and Police FC vs KCCA FC matches played on 26th October 2024, 21st November 2024 and 2nd January 2025 respectively. Mbarara City FC further stated that Gavin Kizito Mugweri’s booking in the KCCA FC vs NEC FC match played on 21st November 2024 did not appear on the FCMS-generated match report or the UPL but it was indeed issued. KCCA FC was on 9th January 2025 summoned to file a response to the allegations against them in the petition mentioned herein above. KCCA FC in their response stated that the referee’s report of the match is final and conclusive unless overturned by a competent body. That the report on the KCCA FC vs NEC FC match mentioned herein above did not reflect any caution so accordingly the player was not cautioned on that particular match and consequently he had not accumulated three bookings.
LEGAL FRAMEWORK
The panel in determining this matter took into consideration the FUFA Competitions Rules particularly Article 26 subsection 9 which provides that a player who accumulates three bookings (cautions) in a league and mixed format competition shall automatically become an ineligible player for the next one physically played match.
FINDINGS.
The Panel from its investigations ascertained that;
1. Gavin Kizito Mugweri was indeed given a booking in the KCCA FC Vs NEC FC match played on 21st November 2024
2. Gavin Kizito Mugweri accumulated a third caution when he was cautioned in the match Police FC vs KCCA FC.
3. He was indeed ineligible to play the next physically played match being Mbarara City FC vs KCCA FC played on 7th January 2025 having accumulated three bookings.
DECISION
KCCA FC loses the match No.115 Mbarara City FC vs KCCA FC played on 7th January 2025 by forfeiture and consequently Mbarara City FC is awarded three points and three goals.
